Nursing Home and Financial Elder Abuse

Having been born post World War II, Ms. Cooney is acutely aware of “The graying of America” and the fact that people are living much longer than before. Our elders deserve our respect and care. California recognized the outrageousness of elder abuse and neglect, and in 1991 passed the Elder Abuse and Dependent Adult Civil Protection Act. This Act applies to persons over the age of 65, and dependent adults (18-64 who are disabled). This legislation not only prohibits nursing home abuse and neglect, but also allows victims to recover pain and suffering, past and future medical billings, and attorney fees. Under certain conditions, the victims of elder abuse may be entitled to punitive damages against the facility.
